The issue is that the lyrics are in a diss track. No reasonable person familiar with the genre takes a diss track to be an accurate factual claim about the world. See p. 15 of the ruling.
The forum here is a music recording, in particular a rap “diss track,” with accompanying video and album art. Diss tracks are much more akin to forums like YouTube and X, which “encourag[e] a freewheeling, anything-goes writing style,” than journalistic reporting. Sandals Resorts, 86 A.D.3d at 43 (quotation marks omitted). The average listener is not under the impression that a diss track is the product of a thoughtful or disinterested investigation, conveying to the public factchecked verifiable content.

Yes. There is a mountain of precedent that the requirement one have standing (i.e. an actual or imminent injury in fact) to bring suit is a constitutional requirement. Congress cannot confer standing to challenge a law or regulation to someone not actually injured by that law or regulation.
Art. III requires the party who invokes the court's authority to "show that he personally has suffered some actual or threatened injury as a result of the putatively illegal conduct of the defendant," Gladstone, Realtors v. Village of Bellwood, 441 U. S. 91, 99 (1979), and that the injury "fairly can be traced to the challenged action" and "is likely to be redressed by a favorable decision," Simon v. Eastern Kentucky Welfare Rights Org., 426 U.

Lots of precedent says advisory opinions are unconstitutional under Article III. E.g. Flast v Cohen:

And it is quite clear that "the oldest and most consistent thread in the federal law of justiciability is that the federal courts will not give advisory opinions." C. Wright, Federal Courts 34 (1963).[14] Thus, the implicit policies embodied in Article III, and not history alone, impose the rule against advisory opinions on federal courts. When the federal judicial power is invoked to pass upon the validity of actions by the Legislative and Executive Branches of the Government, the rule against advisory opinions implements the separation of powers prescribed by the Constitution and confines federal courts to the role assigned them by Article III. See Muskrat v. United States, 219 U. S. 346 (1911); 3 H. Johnston, Correspondence and Public Papers of John Jay 486-489 (1891) (correspondence between Secretary of State Jefferson and Chief Justice Jay). However, the rule against advisory opinions also recognizes that such suits often "are not pressed before the Court with that clear concreteness provided when a question emerges precisely *97 framed and necessary for decision from a clash of adversary argument exploring every aspect of a multifaced situation embracing conflicting and demanding interests." United States v. Fruehauf, 365 U. S. 146, 157 (1961). Consequently, the Article III prohibition against advisory opinions reflects the complementary constitutional considerations expressed by the justiciability doctrine: Federal judicial power is limited to those disputes which confine federal courts to a role consistent with a system of separated powers and which are traditionally thought to be capable of resolution through the judicial process.

This whole thing has a lot of stuff that undercuts their legal claim. Spending time talking about how the plaintiffs are known to be liars and not trusted by anyone is... not good for your case! It feels good to say, but hurts you legally.

I thought this might come up w/r/t the declaration about moving him to NJ. It was super specific as to his movements throughout the night, and then all of a sudden vaguely referenced bringing him to "the airport" without specifying which airport or how.
