The issue is that the lyrics are in a diss track. No reasonable person familiar with the genre takes a diss track to be an accurate factual claim about the world. See p. 15 of the ruling.

Yes. There is a mountain of precedent that the requirement one have standing (i.e. an actual or imminent injury in fact) to bring suit is a constitutional requirement. Congress cannot confer standing to challenge a law or regulation to someone not actually injured by that law or regulation.

And I don't think that Congress saying "courts can do advisory opinions now" makes a case at law for Article III purposes.

This whole thing has a lot of stuff that undercuts their legal claim. Spending time talking about how the plaintiffs are known to be liars and not trusted by anyone is... not good for your case! It feels good to say, but hurts you legally.

I thought this might come up w/r/t the declaration about moving him to NJ. It was super specific as to his movements throughout the night, and then all of a sudden vaguely referenced bringing him to "the airport" without specifying which airport or how.
