Your guess is as good as mine. But damage to reputation isn’t necessarily the deciding factor in defamation suits U.S. courts as far as I understand it because he’s a public figure. So that doesn’t really matter.

But again I’m NOT a lawyer so I’m no expert. I’m just looking back at my Constitutional Law class from YEARS ago. I don’t see how “Actual Malice” could be proven by Trump to satisfy Sullivan etc

That’s the billion dollar question! If he had filled suit after losing the election in 2020 maybe he could make a case for that but he’s saying that his reputation was harmed by something that happened AFTER the election (using speeches made January 6th 2021, correct?) and he was reelected in 2024.

I believe that Trump would have the burden of proving that the BBC intended to inflict “actual malice” upon him as a public official. I don’t see how that is possible at all.

Sullivan is kind of interesting in that it’s connected to the Civil Rights movement. Another important case is Hustler Magazine v. Falwell, 485 U.S. 46 (1988) which was featured in the movie The People v Larry Flynt.

But even in the past 5 yrs our foundational case New York Times Co. v. Sullivan, 376 U.S. 254 (1964) has stood up at SCOTUS. At least as far as I understand it. The Wiki article is decent if you want to read more

They go back to DC and the Congressperson is wildly successful & makes changes that improve the country.
