The obvious answer to this consultation is that the biggest challenge posed by electronic communications is that it has become so cheap that @ec.europa.eu can run a year-round #DDoS attack on stakeholders—by launching one consultation after another.

Seems to me that the underlying assumption of both Acts — that businesses don’t share data because they lack regulatory certainty — might simply be wrong. Seems more likely that businesses dont share data because they view it as a competitive asset. And that’s not something EU regulation can change.

That’s an excellent question — one I’ve been asking myself as well. They are both a bit of a grab bag of measures, but I have yet to see evidence of real impact toward the stated regulatory objective: stimulating the data economy through more data sharing.
