DHS has recently taken this position in (immigration) court, and many immigration judges are agreeing with it, even though it ignores decades of case law and precedent. The higher courts haven’t had a chance to weigh in yet, and there’s some concern that SCOTUS will let them get away with it.

The short answer is that he’s absolutely wrong, based on what the law has been for 30+ years. What he’s referencing is a complete shift in DHS (and, to an extent, DOJ)’s interpretation of the law.
