In fairness, Bowers was poorly briefed. Different, more favorable historical facts were only presented to the Court in Johnson, and that showed in the two majority opinions.

Arlington recently changed the law from prohibition on sidewalks to the 6 mph rule. I became aware of the change after I posted. 6 mph is jogging speed. We can all make our assessment if the scooter was going faster than a jogger.

I agree about the duty of care for the driver, but when the driver started moving the scooter was not yet in the crosswalk and probably wasn’t even visible approaching on the sidewalk due to the car in between. If scooter had been going <6 mph the white car would have passed safety in front of them.

Scooter driver is lucky. White van was only accelerating from a complete stop. Motor scooters are not permitted on the sidewalk and should be walked (not driven) if in a crosswalk. This is why.

Both seem exaggerated. Left side is more likely “I can’t find a place to live near work without roommates.” Right side is more often “my kid’s class has been in a trailer 3 years in a row.” Neither is the end of the world, both suck, neither is imagined.
