There is always room for improvement, of course. I had my frustrations. But I could see the progress from Obama's admin to Biden's, and Biden's admin had a lot of Trump cleanup to do too.

I feel like a lot of people genuinely don't understand or know what government does and focus way too much on what a politician says. Biden's government was the best the US has ever had on LGBTQ+ rights, especially trans rights. Healthcare regs, education regs, anti-discrim enforcement, judges, etc.

That is exactly right. They could win that defense (assuming Cooper doesn't just dismiss that claim) and it doesn't matter. They still lose the public accommodations claim. Under the MHRA, public accommodations cover a lot. Hospitals, restaurants, theaters, sports teams and competitions, etc.

The court calls it partial SJ on the public accommodations claim because with affirmative SJ, the district court will still need to decide damages. And the statute is fee shifting.

Note that the legitimate business purpose defense is like a BFOQ that only applies to one of the two provisions of the MHRA. It is a complete win (affirmative SJ) for Cooper on the public accommodations claim. Public accommodations are defined very broadly in the MHRA.

This must have been a thing on the right wing media of the day because my *dad*!! published an op-ed in the local newspaper saying the same, that business owners were essentially being *enslaved* by being forced to provide service to black patrons.

I am concerned about the fact that the Biden administration apparently plans to leave this out there, open, as a proposed rule that has gone through notice and comment without finalizing a rule. That invites the Trump administration to piggyback on their work to immediately issue a horrific rule.
