I would almost put money on this requiring a referral to the Supreme Court and a nonsensical preliminary reference so that they can be informed about primacy and disapplication, again when the High Court is unsure of what to do with the CoA decision

The Court of Appeals should not have heard the action with a preliminary reference pending - but the Superior Courts are often quite poor on the fundamentals of EU law

See, this answer seems catastrophically bad and cack-handed if you’re a disillusioned Labour voter or (god forbid) further left. But if you’re an executive at, say, Serco, G4S or Mitie, and want to know the status quo will hold and your contracts will be renewed with minimal hassle, it’s beautiful.
