That makes sense! One last thing another issue to navigate is that many of the agencies have it written into there statues that the policy exception in CSRA refers only to political appointees and I think even some appropriations have that in their also. This will be a mess!

If you had to guess will this thing have to be modified over time? Some are saying they are just going to go all in and they think SCOTUS will ultimately overturn CSRA, I am not sure that’s a good bet to make.

I’m not a lawyer like you, but I am not sure it strengthens there case to argue that the CSRA is unconstitutional. Also how this thing will get implemented is an open question, my guess is it will be a colossal wreck.

ALSO the notion that the CSRA imposed a bunch of constraints on the president and was an "overcorrection" is bananas. The legislative history is replete with Congress acknowledging they were expanding the president's powers. Stay tuned until next week-ish if you want 80 pages on that...

There are multiple legal challenges pending against this rule. Also there is question as to how quickly it will be implemented and what congressional pushback will occur. SSA already has had to walk back some of their Schedule F plans and does anyone know if a review of positions has been done?

Similar questions were asked by some Department of Justice officials during the Bush Administration. The Inspector General ultimately found that those questions violated the civil service laws. I don't think the fact that its "optional" changes the calculus. 2/2
