Yes, at the moment, their stupidity is their weakness. It keeps their approval rating in the toilet which fosters resistance.

If you mean "fair" as "unbiased", there is no known way to get unbiased decision makers. It's part of the reason for the checks and balances system.
What has to be appreciated are that written laws will always be imperfect and that there's an intrinsic role of human interpretation.

Fascists have an opportunity to make inroads as long as the paradox of intolerance is ignored. Fascism is a set of 4 ideologies. So controlling it starts at the free speech level. Tackle that and the corporate collusion aka corporatism.

A big part is simply reinstating the power of Congress and making laws ensuring that institution works for Americans.
