The fact that counsel for the complainant had to spend so long going through the log might be an indicator that laziness was the predominant factor. But, you don't act that way unless you have a real contempt for the opposing party.

There could be lots of reasons why the handling was so slapped –-incompetence, simple laziness or perhaps a contempt for the complainant who had the temerity to challenge the constabulary. I suggest that it is a combination of all three.

How can a suspect be sure that the prosecution have disclosed all that they should?

The schedule is prepared before the suspect is charged.I'm guessing that the schedule was defective and didn't mention the BWF. If I'm right then this has serious ramifications for virtually every case in that area that goes to trial.

You ask why the mistake was spotted so late. The answer is I think quite simple. The handling of the case by the Constabulary was slapdash from beginning to end. As this arose out of a criminal charge, all the BWF should have been on the schedule of unused material.
