I'm not sure why this is fatal. They voted no on 1, yes on 2, yes on 3. Comey is charged with 2 and 3, not 1. What's the problem.

Of course the proclamation freed only slaves in areas the North had no control over and intentionally didn't free a single slave in the areas they did have the ability to free. In other words it was cynical propaganda. The Civil War was originally sold as maintaining the Union. Lincoln explicitly
