The DPC’s decision shows that human intervention is required in a significant proportion of cases. Approximately 35% of new registrations are referred for human evaluation, while for PSC renewals, 95% of one-to-one matches and 45% of one-to-many matches require human review. The DPC notes:

The DPC pointed out that the Dept simply did not do its job despite its vast resources.

This is despite the DPC finding the infringements to be of a “high gravity” and “serious nature” and that the Dept was “negligent”.

It turns out the DPC initially ordered the Dept to stop processing. But the regulator subsequently changed its mind and gave the Dept nine months to find a legal basis after the Dept made submissions on what that would mean for the “State’s social protection infrastructure”.
