It definitely grabbed my attention, as I'd not heard of it before. But I'm still skeptical. I haven't seen any evidence that this is a thing. And I struggle to think of what statutory basis LE would have to ask ISPs to do this. Doesn't fall under the Wiretap, Stored Comms, or Pen Register Acts.

Judging by the Restatement, Intel v. Hamidi, and Intel's progeny, this would indeed seem to be a trespass to chattels if police acted directly on the Wi-Fi (via signal jamming or deauthentication attack). But remedies would be (trivial) damages rather than exclusion of evidence or anything useful.

I did some pole attachment work (the legal kind, not the back-breaking kind) in private practice. A law school colleague of mine has made an entire career out of it.
