IANAL but (heh) even then Congress would have to make the argument on scope of interstate commerce for such a law to be constitutional without amending the Constitution

Whether or not such an unconstitutional law would withstand a trip to the current SCOTUS not withstanding

Congress COULD try to pass a law preempting States given their Constitutional power to regulate interstate commerce but that has a narrow scope like the sale of goods across State lines

An executive order only affects the Executive branch. Congress has the ability to pass laws that can preempt State law, provided it falls within its Constitutional duties and not afoul of the 10th amendment. The President doesn't have the ability to order States to do shit.

Remember, internally polling saw her losing a senatorial election against Ossof and that was with Trump support and prior to the GOP's shitdown, and then Trump himself refused to back her in the primary. Probably retaliation for McCarthy and the E files. That was when she suddenly got "reasonable"
