Musk has no legal authority, but Congress is doing nothing about it because the Republican majority feel like they can't go against Trump - even those who don't like what he's doing. That would only change if they think that their Trump-supporting voters are freaked out about what Musk is doing.

He said he would block unanimous consent on all Department of State nominees. As I said, there is little that the dems can do right now in the Senate other than throw sand in the gears and slow things down. They also need to pick their battles.

Dems have little power to stop that right now without getting at least a few Republicans on board, which is exactly why every Senator, including Republicans, need to hear from their constituents. That said, they're doing what they can. Brian Shatz, for example:
