In light of the story about hundreds of detainees disappearing after being sent to Alligator Alcatraz, reposting this here. These are enforced disappearances under international law. The systematic top-down practice raises questions as to whether these amount to crimes against humanity.

This is an enforced disappearance under international law (1. Detention; 2. By state agents; 3. Hiding the fate or whereabouts of the individuals). DHS has a long history of forcibly disappearing migrants as a border management strategy, but it has gotten considerably worse under this administration

Attended the annual American Immigration Lawyers Association conference last week, and was inspired by one of the veteran speakers who quoted heavily from The Dual State, a book by a German labor attorney who was practicing law at the start of the Third Reich. Bought the book. Do recommend.

A smattering of UN human rights experts have published joint allegations against the US government for disappearing people to El Salvador. These only become public 60 days after transmission, so that’s we’re only seeing this just now.

Good to see US lawyers recognizing how the US Gov is forcibly disappearing migrants. We need advocates to continue to use this accurate language. It can create movement for the passage of human rights legislation to prohibit and criminalize enforced disappearances and to ensure remedies for victims.
