Haven’t read the article yet, but I’m guessing the real issue is the whole life policies, a weird hybrid of insurance and an investment product that does somewhat worse than just getting a term life policy and investing in index funds.

It’s about as good as Garcia’s attorneys could hope for. The judge believes the facts alleged could be enough to prove vindictive prosecution and wants to see the documents him/herself to decide whether they are relevant to that claim. Judges rarely take that step.

In my state, all manners of police chicanery are indemnified by the state (or muni). Which is good for plaintiffs - at least someone’s holding the bag.

Qualified immunity is also a defense in claims against state LEOs. So is there a distinction with federal officers, or is it the same problem in both contexts?

State tort claims (including false arrest and assault/battery) are available under the FTCA. Why were those not an effective remedy?
