That doesn’t mean they won’t do it though, it just means they would have to sign their names to a laughably absurd opinion - something they’ve shown themselves willing to do, but not consistently. So we’re all holding our breaths today.

Since her case is about how her rights as a private citizen intersect with her rights and obligations as a public servant, it would take a bizarre leap of logic to strike down same sex marriage, because those are two different questions.

Most people think they will decline to accept it, not just because she has lost so many times, including once before the Supreme Court, and not just because her case itself is weak, but because the way it’s framed doesn’t really open the door to overturning Obergefell.

But instead of processing what literally everyone has been trying to tell her for over a decade, a very simple civics lesson about being a public servant in a democracy, she is appealing again to the Supreme Court. Today they will decide whether to hear her case.

She is free not to recognize marriages as a private person, but as an agent of the public, the correct way exercise that freedom would have been to resign. She has lost court case after court case and been ordered to pay hundreds of thousands of dollars in damages.
