Even members of the Court acknowledged the ban is vague and confusing, leaving physicians unsure when care is legally allowed. When providers must choose between treating a patient and risking prison, healthcare becomes dangerous.

Under this law, providing an abortion is a felony punishable by up to five years in prison and a $10,000 fine. Patients are exempt from prosecution, but their doctors are not.

This matters because:
• Many Native people receive their health care primarily or exclusively through IHS
• Access to non-IHS care may require traveling long distances, time off work, childcare, and fuel costs
• Delays in accessing abortion often increase medical risk and cost

Hyde prohibits the use of federal funds for abortion care, which means that Indian Health Services (IHS), a federal program created as part of treaty obligations, cannot cover abortion in most circumstances.

There's a clear disconnect:
-Most people, across parties and regions, reject using the criminal justice system to police abortion.
-Even those who believe abortion should be illegal oppose jail time for pregnant people & doctors.
-Harsh laws deepen distrust in the legal system & endanger lives.

Since the Supreme Court overturned Roe v. Wade, more than half of U.S. states have passed laws that criminalize abortion. Some threaten doctors with prison time. Others allow private citizens to sue anyone who helps someone get care. And a few have even proposed classifying abortion as homicide.
