What is also interesting is that at [55] of the judgment it becomes clear that this was not an isolated incident by the barrister in question.... I wonder how, if at all, this will impact the referral to regulators.

All relevant legal methodologies are welcome, including doctrinal and comparative research, as well as interdisciplinary perspectives, whether theoretical or empirical. The manuscripts will be due by mid-September 2025 and, subject to peer-review, published in May 2026. 🧵4/4

Agree completely — not just enough to assert substitution (or significant substitution) but to prove perfect (or virtually perfect) substitution, which is a very high burden. Also, very clear summary on downstream emissions and MSA in the case at [187] by Holgate J (as he then was).

Very interesting decision and very interesting consideration of the market substitution argument, which hasn’t been considered in substance earlier (by the English courts).
