The Dept. of Education, in its current incarnation, was created by an act of Congress, as were many of its subsidiary programs, including the IES. The head of DOGE was not elected by the people, nor vetted by Congress through the process of a cabinet appointment. These are the only two ways people in charge of federal budget decisions can be hired, according to US law. The IES is being defunded by this unelected, unapproved private citizen.
