Nearly everybody loved the New Deal. I loved it when I read about it. The Government was engaged in a program of sustaining the people. Such a thought is anathema to Republicans today.

You saw the first paragraph and the "reasonable" language. That is the clue to the future lawsuit. Any reasonable actor would have known that indicting Comey under the circumstances would be a clear violation of his constitutional rights. The type of lawsuit is called a Bivens action.

The language at the b eginning of this motion tells me that the Defense believe (with some justification) that Trump's actions will lead to a Constitutional Tort action against several government actors.
