NB: $10.7 billion is undoubtedly an underestimate. Total oil sands mine closure estimates have swung wildly in the past 4 yrs (graph), which tells you something about their reliability.

Like I said at the outset, 5(1.1) is curiously worded. But any doubt with respect to the above is erased when you read the French version, as lawyers and courts are instructed to do to discern a provision’s proper meaning.

This is allowed under the “double aspects” doctrine. So while fed & prov law-making powers are “exclusive” (only feds can pass laws that are in essence about criminal law), the courts have recognized that one set of facts can have multiple aspects that lend themselves to laws by both levels: 6/n

The answer lies in our constitution. Per ss 91 & 92, the so-called division of powers provisions, both the fed’s & provs’ legislative authority (the “power to make laws” aka jurisdiction) is “exclusive”.

So Parliament has exclusive authority to pass some kinds of laws, provs other. 4/n

Note the plural “areas”.

Both s 91 and 92 grant “exclusive” legislative authority (the power “to make laws” — not over things, e.g. a project). The trick is to understand that projects can fall under both a 91 and 92 (or several of each class therein) pursuant to the “double aspects” doctrine. 1/2
