Statement on David McBride’s Appeal Judgment 28 May 2025 The Court of Appeal has dismissed David McBride’s appeal. We are disappointed — but we are not surprised. As usual, after the judgment, Dvid McBride remained stoic and concerned for others. “I am concerned for my children and family. People who have stood up for what is right in history have suffered far more than I have. I thank god for giving me the strength and courage to fight this battle and the strength to continue this pilgrimage for justice. It is a great privilege to sacrifice for the country and I am confident the outrage produced by this judgment will be felt by all Australians. I will not give up.” We are disheartened — because David McBride is still not coming home today. And that is a failure of justice. We are disappointed in the court of appeal in their failure to appreciate the public interest issues in this case and the ramifications this decision has for other Australians. And that is why we are going to the High Court. David said: ‘It is my own conscience and the people of Australia that I answer to. I have kept my oath to the Australian people” David should never have spent a single day behind bars. Yet as we speak, he is returning to a cold, dark prison cell — preparing for winter in a concrete jungle — while those who committed crimes walk free and those who covered up those crimes have been rewarded with medals and promotions. But make no mistake: this is far from over. We believe that only the High Court can properly grapple with the immense public interest and constitutional issues at the heart of this case. We will be seeking special leave to appeal to the High Court imminently. This case matters to every Australian. Because it cannot be a crime to expose a crime. It cannot be illegal to tell the truth. When a soldier acts on conscience to report wrongdoing, their actions must be protected — and their complaint properly investigated. Otherwise, we are not a democracy. We are something else entirely. The truth is, David McBride has had everything taken from him — but he has not wasted a single second in prison. He has spent the past year becoming mentally, physically, and spiritually stronger than ever before. And when he is finally released — as he will be — he will emerge more determined than ever to serve the public interest and pursue justice for all Australians. It is now time for the Attorney-General to show leadership. To show Australians that this Labor government will no longer jail whistleblowers. To recommend a pardon — so David can return home to his daughters, to his family, to his community, and to a country that must be brave enough to face the truth. Because until we stop punishing those who speak truth to power, justice will remain out of reach for us all.

McBride appeared in the courtroom for the less than 60-second hearing to learn his fate: he is going right back to jail. McBride has nearly five more years in jail to serve for leaking documents to the media exposing Australian war crimes in Afghanistan. This means all of his appeals, including liberation from jail, a reduced sentence or community service were rejected out of hand. McBride waved to his lawyer Eddie Lloyd and just a few of his supporters who found out which courtroom it was in. Normally a huge board in the lobby of the courthouse posts the names and courtroom numbers on the docket that day. But McBride's name was nowhere to be found keeping supporters from entering the courtroom.
