It was further related that on 12 February 2003, the night before Ms. ______ was to leave for a trip to Florida, Officer Catanzara repeatedly called her cell phone, but she did not answer. She then found a bag containing a red bikini and two White Castle hamburgers from Officer Catanzara on her patio. Officer Catanzara called her later that night, and told her that he had left her the bag. She told him that she did not want the gift. Officer Catanzara told her that if she did not want the gift, she should return it to him or give him the $97.00 that it cost. He told her that if she did not return the gift or give him the money, she should not show her face again in Illinois, because he would embarrass her.

4 The Court regrets that the world of the magistrate judge does not offer more time to compose scholarly, detailed memorandum opinions explaining the intricacies of its rulings. The Court learned of the government dismissal motion in this case this morning. There is value in a contemporaneous explanation of the Court's action, for better public understanding of a judge's role, and here, of the unusual circumstances this and the other Broadview arrest cases involve. A same-day opinion will have to suffice. 8

BWC footage depicts agents walking up to and forcefully shoving a protester to the ground. Axon Body 4 Video 2025-10-04 1541 D01A83204 at 16:14-16:16. After the protester stood up, an agent pushed him again. Id. at 16:16-16:19. The protester then attempted to push the agents away from him, at which point multiple agents ran up, grabbed him, and forcefully tackled him to the ground. Id. at 16:19-16:37. Three agents managed to detain the protester, but 113 Case: 1:25-CV-12173 Document #: 281 Filed: 11/20/25 Page 114 of 233 PageD #:7328 then inexplicably let him go. Id. at 16:54-17:11. One agent appears to have kicked the protester while walking away. Id. at 17:10. The protester attempted to stand up after agents let him go, and agents then immediately and violently tackled him to the ground again. Id. at 17:10-17:17. They then pushed and knelt on the protester's head and neck as they handcuffed him: Id. at 17:27-17:40. When asked about the incident a few minutes later, the agent wearing the BWC falsely claims that he got "assaulted by [the] protester." Id. at 23:23-23:26. According to CBP reports, CPD assumed control of all scenes at approximately 3:03 p.m. Doc. 191-8 at 1. At this point, agents "were informed over service radio to use all means necessary to ensure their safe exit, to include the use of deadly force." His detailed on-the-record account of 53 days in custody is one of the most extensive by any person caught up in the ICE dragnet. Patino went over what he went through the day he was arrested and his subsequent incarceration at the Broadview ICE facility and jail in Indiana where he was also held. He described cramped, dirty facilities at Broadview where those being held had to gather together for warmth. They often slept standing up or sitting on a cold floor and were given inadequate amounts of food and water. Jose Patino was released in early November without any charges. Representatives from ICE and DHS did not respond to requests for comment for this story. Patino was soon taken back to Broadview, where he spent about 12 hours at the ICE facility before being put on a bus with dozens of other prisoners in the middle of the night. After riding for a few hours, Patino said he went into "panic mode" when they arrived at a small airport. "I thought, this was supposed to be simple and I was supposed to get transported back the way I came in," he said. "I thought, there's no way all of these people are going to Clay." As the van turned into the airport, he feared he was being deported. "I'm like, great, they're definitely taking me to Texas or to the border or wherever they take people to be deported," Patino said. "At that point | was sure that I was going on this plane and I'm really going into panic mode," Patino said. Despite his fear, Patino was not put on the plane. Instead, officers separated prisoners for the flight. Patino and a few others were driven back to the Clay County Jail. He said the entire "ordeal" at the airport played out over the course of many hours. During that time he had no idea where he would be taken.

Todd Blanche, the deputy attorney general, issued a statement saying that I was lying about the circumstances leading up to my firing. Then I was invited by the Democrats on the Judiciary Committee to testify in front of Congress. The administration sent armed U.S. Marshals to my home to deliver a letter warning me about testifying. A career employee who was still at the department helped me get it called off before they got to my house, where my teenager was home alone. I felt the purpose was to intimidate me. And I think it was intended to send a message to other department employees, too, who might be thinking about speaking up. I needed a lawyer. I spent the entire weekend calling all of the lawyers that I know at law firms around D.C. Everybody I talked to was saying: "Thank you so much for what you're doing. We'll do whatever we can behind the scenes to support you." But nobody actually wanted to sit behind me at a congressional hearing. Nobody wanted to put their name on a letter to Todd Blanche.

Lewis didn't say so in that passage, but the outcry over the image of that assault instructed movement leaders in an unhappy truth about the country: Americans responded much more vigorously to seeing white protesters being beaten than they did to seeing similar suffering among Blacks. It was a severe but realistic lesson that the Movement would apply repeatedly in the following years. Politicians tend to be hypersensitive to increases in political power, even if they don't know quite how to respond. Two days after the mass arrests, the mayor of Nashville finally agreed to a meeting. However, he used it to denounce the students as criminals. Lawson responded that "where the law was used simply to oppress people, then it wasn't really a law," because it was neither just nor Christian. The major result of this meeting with the mayor was unexpected: Vanderbilt's divinity school expelled Lawson as a graduate student. This was another sign that the white people running Nashville still had not fully grasped what they were up against. The expulsion of Lawson resulted in a wave of faculty protests and denunciations from universities across the country, damaging Vanderbilt's national reputation, which was valuable to Nashville's establishment. More than half the faculty of the divinity school threatened to resign. Ultimately, the university offered to reinstate Lawson while removing the dean of divinity, an outcome Lawson rejected as equally unacceptable. The mishandling of Lawson ultimately provoked the American Association of Theological Schools to place the divinity school on a year of academic probation. Thus, ironically, the school wound up in more trouble than Lawson.

Two agents in masks followed him into an area of the school "where special education students start their day" and came out about a minute later with the man in cuffs, according to school officials and Gomez's email. One student was reported by the student's parents to have been pushed out of the way by federal agents during the arrest, according to Gomez's email. Volunteers welcoming students to school included the Rev. Benjamin Squires, pastor of a nearby church. "When I saw the men being detained outside [the school] that day, my faith required me to say something," the pastor wrote in a sworn statement for the lawsuit over agents' use of force. "I pulled out my phone and attempted to record the agents' actions." In response, he said, the agents threatened to pepper-spray him. Squires said he started to walk away, and again an agent threatened him with pepper spray.

You can’t be fully unaware of how much preparation went into the sit-ins and freedom riders and marches, but the gritty details are very illuminating herein.
