The civil penalty, totaling $1,055,825, was issued for numerous violations of environmental regulations for water quality, hazardous waste and spill response and cleanup at Stella-Jones’ facility, according to DEQ. The agency said most of the penalty — $877,225 — is for “economic benefit, or costs and expenses that the company avoided by not complying with environmental regulations.” DEQ said it issued an order requiring corrective action in 2023, which was complied with, and three pre-enforcement notices outlining 23 violations in the past two years. In a notice of civil penalty letter to the company, Saylor said DEQ would consider reducing the fine amount if corrective actions are completed. “DEQ appreciates your efforts to address some of the violations and considered these efforts when determining the amount of the civil penalty,” Saylor wrote. The order requires the company to amend hazardous waster generator reporting, evaluate waste tanks for compliance, upgrade its stormwater treatment system, revise a stormwater operations and maintenance plan and increase its stormwater discharge monitoring and reporting. The letter includes a 22-page findings of fact that details Stella-Jones’ operations and several years of inspections and violations. The company discharges stormwater into South Yamhill River through a ditch along Rock Creek Road that flows through a culvert under the West Valley Highway. The DEQ noted the company has not been issued a permit to treat, store or dispose of hazardous waste at the facility, but generates at least 2,200 pounds of hazardous waste monthly. It also states that approximately 3.8 million pounds of waste, debris and sediment from the facility’s stormwater treatment systems were disposed of at the Riverbend Landfill (2013-2021) and the Coffin Butte Landfill (2021-2022). Stella-Jones has 20 days to appeal and request a hearing with DEQ.

DEQ issues $1 million civil penalty against Sheridan wood treater The Oregon Department of Environmental Quality on Monday, Sept. 8, issued a $1 million civil penalty against the Sheridan wood treatment facility owned by Stella-Jones Corporation, a multinational Canadian company. “This enforcement not only addresses the company’s past violations, but also requires the company to revise its operations plan, conduct additional monitoring, and take other preventative measures to ensure it stays in compliance going forward,” said Erin Saylor, interim manager of DEQ’s Office of Compliance and Enforcement. “Enforcement of environmental laws is critical to deterring future violations, ensuring a level playing field, and ultimately protecting public health and the environment. DEQ hopes the magnitude of this enforcement will further these goals and result in long-term compliance at the facility.” The announcement comes less than two weeks after a report by nonprofit news outlet Investigate West that was critical of DEQ for being too lenient about the company’s previous violations and withholding information about pollution from the public. The investigation was published last week in the News-Register and several other media outlets. The report detailed how Stella-Jones was repeatedly warned that stormwater it released into the South Yamhill River over the last four winters contained too much pentachlorophenol — a once-banned compound used to treat lumber products that poses significant health risks and has been linked to cancer. On Aug. 25, Stella-Jones pleaded guilty to 10 misdemeanor charges of unlawful water pollution, brought by the Yamhill District Attorney’s Office and prosecuted by a state Department of Justice environmental crime expert, InvestigateWest reported. As part of a plea agreement, Stella-Jones agreed to pay a maximum of $250,000, in what DEQ called a parallel state criminal case based on water quality violations.
