SCOTUS declined to take up a case designed to undermine a 2001 ruling called Hill v. Colorado. Justice Thomas was flummoxed about why when Dobbs, the decision reversing Roe, plainly criticized Hill. But I don't think we can read too much into this.

In the '90s & beyond, groups like ADF opposed heightened scrutiny for ALL sex classifications, something I'm writing about (see an example below).
That makes one thing clear: if Alito can create a Dobbs/Geduldig exception to equal protection, it will have much further-reaching implications.

Last week, Justice Alito suggested that Skrmetti case was about much more than transgender youth. He implied that states can discriminate based on sex so long as a law focuses on "a medical condition or procedure" related to sex. He calls this the Geduldig/Dobbs approach:
