Pretty sure it is. It happened in Quebec during the 2018 legislature, i would guess it would too in Ontario
PQ and QS were tied at 10 seats, but PQ had a % of the vote advantage on QS, giving them second opposition status (and QS third)
a few months later, PQ lost a seat, so QS became 2nd oppo
