Why did this take so long?
The process is long. The persecution must gather evidence to see if the case falls within its jurisdiction, following national proceedings, and if opening an investigation serves justice & victims. The ICC can't arrest citizens; countries must do so & bring them to court.

The Philippines joined in 2011, but Duterte withdrew in 2019. Since Duterte was President from 2016-2022, any charges brought forth will only apply to the overlapping period of 2016-2019, covering just 3 years.

States / Countries sign to be members of the ICC's jurisdiction. Countries do it for many reasons, but mostly for protection. It protects a country from itself especially when their leaders abuse human rights.

Which court is doing the trial?
The ICC or the International Criminal Court is the only intergovernmental body that has jurisdiction over arresting individuals that commit genocide, crimes against humanity, war crimes and the crime of aggression.
