So in short Red robes but with KC- circuit Judge. Red robes without KC could be HCJ or CJ, given away by title Mr/MrsJustice = HCJ. Part time recorders wear their bar robes whether silk or stuff, depending on rank. None of those in red are “recorders drafted in”. hope this helps.

Those in red are not part time recorders, they hold Honourable recorderships of cities and are allowed to wear the red regalia. They are full time Circuit judges. Ordinarily High Court Judges wear red robes. But if you see KC - not a High Court judge as the rank is relinquished upon appointment.

But delay does mitigate. Very difficult to send someone in who would get say 3 years, if they are not even charged for 3 years and their case isn’t heard for another two. This is now normal.

Significant delay is always a mitigating factor. I deal with cases every day that would have attracted custody had they been dealt with quickly. But we are now dealing with delays of 5years +.

They will be prioritised so the message goes out. This is not the Government reacting, it is the independent judiciary enforcing the rule of law.

Violent public disorder demands swift and heavy sentencing. It undermines everyone’s sense of security. it is the same nape as it was in the 2011 riots. Deterrent sentences are necessary.

It is like no one in the media understands credit for guilty plea. Even the most challenged of defendants understand this concept. Moreover comparing apples with oranges.
