And, no, that’s not being nihilistic. It’s accepting our law is broken and going from there.

Recognizing it for what it is isn’t normalization. I’m not sure that what you’re trying to get done can be done under our existing laws. That’s a problem.

I think it more likely their counsel says the Speech or Debate Clause may give them cover for now, but that political winds are shifting and that may not be true going forward.

Legal counseling shouldn’t be about absolutes. It should be about risk assessment and various options to mitigate risk.
