Still not a lawyer, but it seems legal. Cost of this maneuver will come down to public perception. FWIW voters don’t seem to care a ton about the nitty gritty procedures and rules of the legislature. GOP will be outraged, DFL will be supportive. Everything remains the same.

Additionally there’s MS 3.02…if you have an election certificate, it’s your seat unless vacated (see 40B). Election certificates are not distributed on the first day of session.

I’m not a lawyer but I don’t see a specification of timing here expect “before entering upon his duties.” MS 3.05 refers to the organization of the legislature to officially conduct session not to administer the oath of office.
