So, 31 years after the genocide in Rwanda, 24 years after his initial #indictment, 13 years after his referral to Rwanda, and 2 years after his arrest, Fulgence #Kayishema remains where he is.

The South African government have been asked to file - confidentially - within 21 days.

Today, #IRMCT judges called three of these arguments [2-4] "hypothetical" and "speculative".

They have, however, asked the #SouthAfrica Government to file submissions on argument 1.

In August 2025, his confidential motion requesting the revocation of the referral of his case to #Rwanda listed 4 key arguments:

1) "ongoing threats to his physical safety"
2) political interference with 🇷🇼 judiciary

In 2023 he was arrested in 🇿🇦, working as a security guard on a farm in "wine country", outside #CapeTown. He had identified as a refugee from #Burundi, going by Donatien Nibasumba. He told arresting officers: "I am not Fulgence Kayishema. God will be my judge".

In 2001, #ICTR judges confirmed an indictment against Kayishema for #genocide, complicity in genocide, conspiracy to commit genocide, and the crime against humanity of #extermination. In February 2012, his case was referred to Rwanda, to be tried there upon his eventual arrest.

#Kayishema was an inspector of judicial police in 1994. He was based in Kivumu, a commune in Rwanda's 'Kibuye' prefecture, in the west of the country [in yellow on the left of the picture].
