There was a brief moment in the early ‘10s where it seemed like things were always going to keep getting better. Can’t pin it down precisely. Frankly, now the “before times” just feels like a hallucination. But whatever optimism we had simply lulled us into letting our guard down.

I think in the UK context there’s a particular panic right now about “the boats” — irregular immigration which is not subject to the NHS surcharge. This current wave of hysteria about asylum seekers is far stronger than the generic backlash to immigration which has receded from its peak.

In this context it is made up. Democrats “codified” gay marriage in 2022, but it can still be overturned by the Supreme Court. Just like they overturned the Defense of Marriage act in 2015 when they legalized gay marriage. SCOTUS can strike down laws passed by Congress, that’s its job.

“Codification” isn’t a real thing, it’s cope invented by those who want to justify not taking notice in 2016 when 3 SCOTUS seats were up for grabs. Supreme Court rulings take precedence over Congress. If they deem it to be a matter for the states, nothing to be done but take control of the Court.

Introducing is pretty easy. But getting a vote on it, when you don’t have the gavel, and then getting a 2/3rds majority, is a matter of science-fiction in today’s Congress.
