It’s even worse than the Atlantic article describes it. The substitute prosecutor’s rationale for not prosecuting Trump seeks cover from Jack Smith — but it blatantly misrepresents Smith’s conclusions. Smith was clear that he would prosecute. Good analysis here: www.emptywheel.net/2025/11/26/i...
