There’s no penalty or repercussions for releasing the documents. I also take protecting victims of sex crimes EXTREMELY seriously (as does every other journalist I know) and would never publish any identifying information about a victim without their consent.

Their reasoning to pass the law they claimed was to protect victims. Makes sense. However, it’s ended up protecting those charged with the crimes. Clerks are confused by the law, some don’t follow it all (either knowingly or unknowingly)

Not so fun fact about this story. I had to jump through hoops and fire to get a copy of this criminal complaint in magistrate court. Took 2 days when it should take 30 seconds. The reason - the WV legislature made it illegal for clerks to release complaints for defendants charged with sex crimes.
