Not really. Thanks to the Supreme Court, the claim more or less justifies itself. I can't even recall the last time that attempts to override this defense worked.

It sucks and we hate the pain this will cause, but what the hell else besides pain ever motivates action? We've relied for far too long on flimsy laws battered by SCOTUS for many of our citizens to be treated equally. It's clear these people will stop at nothing. The courts are not our friends.

What Democrats need to now do is stop expecting to save governments and universities and independent agencies with press conferences. They need to be in the streets and organizing a general strike. We need to end this shutdown brinksmanship forever.

My entire adult life every shutdown has boiled down to a game of chicken, but only the Democrats blink. They do so for arguably laudable reasons, but they never face up to the bully. So Americans' lunch money is taken time and time again.
