Ultimately, the Office concludes no changes to copyright law are needed to address AI-generated content at this time. Human creativity remains the core requirement for copyright protection.

💡The Office also finds that using AI as a creative tool—such as for brainstorming, assisting in drafting, or editing—does not disqualify a work from copyright.

The final work must still meet the originality threshold.

Importantly, providing prompts alone is *not* enough for copyright protection. The Office finds that prompts are instructions, not expressive authorship.

Copyright requires a human’s creative control over the final output.

However, human involvement matters. Copyright protection may apply when:
• A human’s creative input is *perceptible* in the AI-generated work.
• A human selects, arranges, or *modifies* AI outputs in a creative way.

The Office affirms that copyright applies only where *human authorship* is present.

If an AI system autonomously generates material without human creative input, that output is *not* copyrightable.
