In their minutes from 24th April, the EHRC justified a rushed consultation on the grounds that "EHRC had undertaken extensive stakeholder engagement on the definition of ‘sex’ in the Equality Act over recent years."

In discussion the following points were noted: The EHRC’s duty to act, and act quickly, to provide guidance on the practical implications of the law. Taking steps to counter mis- and dis-information relating to the law in this area was necessary and required, including as part of the duty to foster good relations in the Public Sector Equality Duty, and under the powers of sections 13.1a and 8.1a, b, d and f of the Equality Act 2006. A full public consultation exercise had recently been conducted on the draft Code of Practice. EHRC had undertaken extensive stakeholder engagement on the definition of ‘sex’ in the Equality Act over recent years, including ahead of and after providing advice to the Minister for Women and Equalities on 3 April 2023. The Supreme Court had made the legal position clear, and so the EHRC’s obligation is to help people understand the practical implications of the judgment. An updated Code of Practice should be an important, but not the only, mechanism for discharging this obligation.
