Escalated to sr mgmt and directly to their engineering team and they’ll be updating me. Thanks to the Apple Support folks I spoke to, A+ response.

NO software should ignore the settings you give it, ESPECIALLY not software that affects your privacy.

For now you can disable it under Settings > Apple Intelligence and Siri, and disable the “Apple Intelligence” toggle up top.

But right now I’d be checking this every time your phone reboots.

I’ve reported this to Apple as a security vulnerability via a Support ticket and will be calling them shortly to escalate.
You should too. This is such a dumb “mistake” to make that it’s basically impossible to believe it’s a mistake.
