When I first heard about this I thought, what about people who have gender-ambiguous names, like Jordan? Or people with names from non-English / non-European languages, who can reasonably expect that most English speakers will not be able to identify the gender of the person from the name?

The Silmaril in the air was still visible in the possession of Eärendil. It doesn't seem impossible that the other two could have been connected to the earth and the sea while still remaining visible in the possession of the sons of Fëanor.

Eönwë should have agreed to return the Silmarils. It's not as though anyone else had a significantly better claim to them than the sons of Fëanor, and the refusal meant that the two other than Eärendil's were lost to all until the end of Arda itself. So, really unhelpful decision.
