Unlike the Archbishop of Canterbury or Alison Kelly, the consultants had no HR powers. Kelly had a duty of care instigate a safeguarding and risk issue. She wilfully refused to, and lied about having investigated Letby to senior management, when she had not.

The police instigated reviews from three further independent neonatal experts plus an expert radiologist & a pathologist.

All agreed that seven deaths counted as highly suspicious by all and ten attempts at highly dangerous harming, enough to satisfy CPS of probable cause and RPS.

After the further deaths of babies O and P (thanks to Alison Kelly's 'wait and see' stance), the consultants did actively block Letby's return. This led Tony Chambers and Ian Harvey to threaten them w/ GMC and to 'manage them out' action plan (see Thirlwall).

They did eventually call in Dr. Hawdon, who said four babies' deaths were unexplained, and nothing to do with sewage or suboptimal care. The Execs did precisely nothing and Letby went on to kill even more babies. So yeah, a year later when they did investigate it was soon proven!

Letby was found guilty by a jury. She is legally convicted. All evidence is circumstantial, even forensic evidence. You are thinking of the term, 'prima facie'. Unfortunately, neonates are unable to describe what happened to them. But there were high-pitched screams which is rare in neonates.

Put the nurse in question on garden leave until investigation completed. Alison Kelly understands this process b/c she had no problems in setting up a grievance process for Letby & 'upholding' it, demanding she return to work. So she ought to have informed the CQC & RHPCH inspectors of the concerns.

...After all, they have no problem at all in investigating Letby's grievances - and the Thirlwall Inquiry has shown they lied about investigating anything seriously - declaring her 'exonerated' and determined to send her back to the neonatal unit where she was a MASSIVE risk and danger to life.

They behaved correctly and reported their concerns in writing and face-to-face to the correct person/s.

If you have an issue at work and go to the police the police will tell you to take it to HR. It was Alison Kelly, Ian Harvey and Tony Chambers' jobs to investigate the Letby concerns. 1/2

See here, how NHS Safeguarding works. Alison Kelly failed to (a) register the concerns as a safeguarding issue and (b) failed to put it on the risk register as a patient safety risk.

See today's Thirlwall hearing. Even the coroner criticised Letby's management for failing to inform them of the consultants' concerns, which they should have done by law.

You cannot run away from the facts.

Sorry, but I think the 'intolerable anguish' of the Babies' parents is more pertinent than 'the intolerable anguish' of Letby's parents, who tried to bully the hospital board into reporting the consultants to the GMC and installing themselves into the grievance process.

People at first couldn't believe Myra Hindley was just as depraved and degenerate as Ian Brady. Took time to sink in. Likewise Ruth Ellis. People assumed it was a 'crime of passion' but actually it was premeditated, cold=blooded. Ellis practised shooting the gun in advance!

Absolutely - but it doesn't mean one should just handwave it away. The head of Safeguarding, Alison Kelly, had a duty of care to investigate whenever a paediatric consultant lodged a serious concern. Not actively cover it up! For two years, during which time further babies were harmed or killed.

Dr Evans spotted a split diaphragm in Baby C, this is factual. How it happened is the 'opinion' part, which he later changed.

Baby C died two days AFTER the routine X-Ray was taken. And Letby was caught at her cot side, despite not being her charge.

That is why generic statistics is not relevant here. It would be like saying, 'What are the chances of the Moors Murders?', for example, and dismissing it as vanishingly statistically remote.

The prosecution did not mention statistics once.

I subscribe to Private Eye and it is superb at reporting on the underdog, such as the PO submasters. But I am afraid Dr Phil Hammond, is simply jumping on a bandwagon this time. He's a comedian and columnist and badly misconceived here.
