So call me crazy, but when let's just say that the artist's page says that uses of said art piece must be asked to the artist and that the piece can only be used in non-commerical works. I think someone is clearly in the wrong in this situation, and it's not the artist.

Regardless, there is a reason why contracts exist to lay out what the Do's and Don't's are for projects. So if you don't do a contract and pay the person via their commission, you technically are playing by their commission rules. The only thing that can be argued is the right to your ip character.

The worse thing is that if the person is using a person's free assets and just tracing them without putting any effort to learn or adding anything to it, and then proceeding to use it in a commercial project.
