The 12th amendment to the Constitution states that a person ineligible to be a POTUS can not be a VP candidate.
The 22nd amendment states that you can’t be ELECTED more than twice.
So, being a successor isn’t necessarily ruled out and hasn’t been taken to the SCOTUS.

They would write it so that it would exclude those that already had two consecutive terms.
