If you want something to say beyond just “this should not be in there”, you are welcome to copy and paste the talking points I submitted about why fictional materials need to be excluded from the guidelines. Just be sure to leave your handle so they don’t think it’s just one person spamming them.
Part of the form you should andwer in, which reads: “Specific Guideline Feedback Are there any guidelines that you feel are overly restrictive or unclear? Please specify and explain your concern.” My answers for the form, reading: Comments (optional) Issues of legality & censorship arise from Section 5-A-ii (Sexual Exploitation & Abuse) particularly part a, b, and d. I will address them each in turn. a) "Share any content that depicts, simulates, or is Al-generated CSAM (child sexual abuse material)—this includes illustrated or animated sexualized depictions of minors." Obviously any *actual* CSAM or Al-generated CSAM using real world materials should be taken down and reported to law enforcement. *Simulated* however is vague enough to infer that art depicting sexual activity between fictional characters (characters gathered from no real- world reference) would be disallowed. While distasteful to many of us, such artwork is NOT illegal in the United States, or indeed, many countries in Asia, Africa, Europe, and South America. Moreover, any algorithm trying to tag and suppress such posts would also inevitably target many classical art pieces featuring nudity of various ages, such as Peter Paul Reubens' "God The Father Supported By Angels" (1600-1603) or Fraçois Boucher's "Autumn: Three Cherubs with Grapes." Potential legalities over the suppression of fictional art and the First Amendment (at least in the US) necessitate the removal of the "simulated" part of the section. b) "Share any content that depicts or promotes sexual activity with an animal." As with the above, we once again run into the legalities of what is legal vs what is considered obscene. Obviously, while real world animal abuse should be reported and taken down, the vagueness of the language could conflict with several points: - Fictional artwork/audio plays/animation/etc. that, again, while perhaps distasteful to some, is still legally allowed. - Adult performers using "Bad Dragon" or similar styled novelty toys or engaging in sex while in fur-suits or mascot helmets. - Anthropomorphic or "furry" artwork, arguably one of the most common artforms on the internet today, could be flagged under such vague wording. - Classical artwork depicting mythological or cultural events of such activities including "The Dream of the Fisherman's Wife" (1814) by Hokusai, "Pan and the Goat from the Villa of the Papyri" statue, and any number of historically important Greek, Roman, and Indian frescoes and pottery. Again, clarifying the language sharing any *real-world* depictions would prevent any legal challenges. Further answers on the form, reading: d) "Share real or synthetic intimate images or sexual content without consent." The language on this is very vague, and would at first suggest preventing sharing private materials without consent or sharing real world images of rape, but could be misconstrued to include fictional depictions of non-consensual sex in art, writing or media. This requires clarity for the following reasons: - Fictional non-consensual sex depictions are not illegal because, by their very legal definition, fictional characters cannot consent or revoke consent by virtue of not being people. This is why multiple such depictions are allowed on television, movies, books, and artwork. Whether they are intended as erotica or dramatic is therefore irrelevant. - Adult performers may sometimes engage in fictional kink roleplay scenarios for videos referred to as CNC or "consensual non-consent." These are power play scenarios common in the BDSM community and involve the full consent of all performers. Without clarity, however, they could be flagged. - Yet again, many classical pieces of artwork throughout history would be flagged under such a ruling, too many even to name all of, but including "The Rape Of Tamar" (1640) by Eustache Le Sueur, "The Rape Of The Sabine Women" (1635-40) by Peter Paul Reubens, and "The Rape of Lucretia" (1630s) by Felice Ficherelli, all shocking but culturally important pieces. Again, clarity is needed in the wording to not include fictional material to avoid any legal challenges. SUGGESTED ACTIONS: Rewording of the guidelines to exclude fictional non-Al-generated materials under the current terms, with such fictional materials posted requiring either the Sensitive Content or Violent Content tags in addition to any Suggestive or Sexually Explicit tags.
