What's the legal authority for the Intel deal?
- CHIPS Act?
- DPA?
- Both?
- Neither?

Big thanks to @petereharrell.bsky.social for joining @scalinglaws.bsky.social to help answer this question & explore the larger policy implications of this announcement.

Let me know! We're working on an AI Benefits Tracker and this is obviously a very important part of that effort.

Headed to Lincoln to talk AI w/ local lawyers.

Surest way to adapt in the Age of AI is to acknowledge it’s here to stay and start experimenting.

Clients will soon ask how AI savvy your firm is…do you have an answer?!

Yes, AI poses risks to democracy. But it can also be democracy's greatest teacher.

I created a prompt to translate founding documents (like the Declaration of Independence) for 5th graders—maintaining meaning while sparking curiosity. Civic (and AI) literacy must start young.

New @nber.org research worthy of your attention this Friday.

Among the key findings: "Using all federal R&D contracts awarded to U.S. publicly traded firms from 1984 through 2015, we find that the average private return on an R&D contract is 19 times its maximum potential revenue."

NBER research w/ big ramifications for all those interested in innovation policy:

"In regions w/ below-median avg adjusted gross income & above-median unemployment, a 1 SD increase in the teleworkable share was associated w/ an incremental 3.8% decrease in new biz registrations"

Your weekend AI homework: listen to this @lawfaremedia.org podcast with @brooksbenjamin.bsky.social (@harvard.edu).

Ben is one of the sharpest thinkers on the importance of open source innovation. As labs pivot to making their models more open, he'll be a key source of policy insights.

Reminder: a self-imposed brain drain cuts against the US being a hub of innovation.

Dan Berulis stepped forward as a whistleblower following DOGE's stop at NLRB.

He warned of ~10GB data being exfiltrated, foreign login attempts & breaches of security norms.

The @theacademyusa.bsky.social announced a new AI policy. It's a big deal with ramifications other than whether AI will win an Oscar.

Every AI conference should include a *proper* training run (and, yes, I'll volunteer to lead it).

Here's how day two started at the AI Safety Law Roundtable!

Thanks again for hosting, @arbel.bsky.social

While students hit the books, AI professors head to Alabama. Great start to the AI Safety Law Roundtable.

It's a real treat to collaborate with @arbel.bsky.social & @petersalib.bsky.social to encourage more profs to evaluate the promise & peril of AI innovation. Stay tuned for more!

What's "marketcrafting"?

Why should you learn about the Reconstruction Finance Corporation?

Who was Nancy Teeters and why should you care about her time on the Fed?

Would you let an AI agent vote for you?

Would you trade control over your ballot for increased participation & decreased likelihood of so-called irrational voting?

Would you welcome an AI tracking candidates / issues on your behalf?

Avoiding reactionary and, ultimately, detrimental AI regulations requires addressing head on the public’s AI fears.

Job loss is near the top of that list.

Rumor has it that some folks have found it to be a great conversation starter for faculty who may be a little AI-hesitant.

Folks immersed in AI need to keep this top of mind:

A mere 11% of the public says that "they are more excited than concerned about the increased use of AI in daily life."

Meaningful adoption will flounder if folks don't trust AI / see how it will benefit them.

Finding the regulatory sweet spot for AI has proven elusive. Some call for excessive red tape. Other schemes may result in innovation-stifling ambiguity.

We’ve got to get this right. My two cents via Yale JREG.

AI innovation doesn’t have to come at the cost of consumer power.

It’s time we moved from "accepting" Terms of Service to shaping them.

How do I know AI is not a "mid" technology?

Mental health chatbots like Therabot could have drastically helped me work through my childhood anorexia.

Yes, there are a lot of bad AI use cases. AND, let's not neglect its potential...
