There are NO real s46 review rights for validity of #NDIS debts. Only unofficial internal review. Because we gave them hell about the former.

You cannot appeal that outcome.

The Agency got related advice in May 2023. Didn't brief the Board on it until September 2024, according to the ANAO report.

The bill passed 22 August 2025.

As at 31 March 2025, the NDIA had $42.6 million in Agency-created debt on hand: • $18.5 million debt for participants (501 participants) • $24.1 million for providers (165 providers). In September 2024, an internal Debt Review Team including representatives from Integrity, Scheme Debt, Service Delivery, and Legal commenced a detailed review of debts. Participant debts were the initial focus given the priority of remediating any participant impacts of debts incorrectly raised. The review of the participant debt cohort is nearing completion. 32 participant debts are still under review. These debts require further investigation, including gathering additional evidence and engaging with the debtor prior to deciding on the revised outcome. The NDIA is in the process of finalising the approach for participant debts requiring remediation. This approach is expected to be resolved by the end of August 2025. The high-level outcomes of the participant debt review will be communicated publicly alongside direct communications with impacted participants.

This thread and the NDIA declining to exercise their right of reply to our June 2024 submission hit differently in the context of the ANAO report.

And yet the NDIA waited until almost a week after public submissions closed to confirm no reply would be coming.

Screenshot reads: Last month the ANAO released an audit on compliance management at the NDIA, which found serious lapses in oversight at the agency. It found the NDIA was raising debts against participants without any legal basis. The report cited an internal briefing that "uncovered a number of issues in the current Post Payment Review process". These included a "lack of alignment with the NDIS Act (2013), resulting in the raising of unlawful debts, inaccurate or absent references to the Act in outbound comms, jeopardising procedural fairness ... [and] an absence of an established quality assurance processes [sic]". These institutional shortcuts have created a historic liability of almost $10 million on this issue alone. They pose significant threats to disabled participants, who are increasingly subject to the vague threat of "compliance" after Labor's sweeping scheme reforms. Those reforms were framed, after market research, as necessary to address an out-of-control fraud problem the government has never been able to define.

What about rural/regional/remote people, though? Because the NDIA is basically saying that if this person can't travel, they can't have therapy unless someone else needs the same therapist, skillset, experience in their disabilities, frequency.

40min each way for me vs extra session in clinic? 🤷‍♀️
The NDIA spokesperson said the agency had heard from participants that "excessive travel claims" for therapy-related services were draining participants' plans faster than expected. "For example, a therapist travelling three hours each way to visit a participant for a one-hour session equated to over $1,300 being taken from a participant's plan," the spokesperson said. They said the updated therapy travel rules would encourage providers to schedule more efficiently and provide clear cost expectations for participants.

It was never listed in the first report because it invoked NDIA right of reply. It was in confidence for five weeks of a media firestorm.

They decided not to reply AFTER submissions to the second inquiry closed.

This Bronwyn? Formerly of DVA? Who argued that NDIS debts simply exist, arising from a series of (highly subjective) facts which cannot possibly amount to a decision that ought to be reviewable?

One expects DSS should approach statutory interpretation according to objects of Acts they administer.
Senator STEELE JOHN: So, procedurally, a debt is raised against an individual, and it is after the point at which the debt is raised and they are notified that the debt has been raised that they are then able to apply for a waiver. Correct? Mr Swainson: Yes, that is correct. Ms Worswick: Yes, it is. I realise this is a technical point, but I think we have to also go back to the point and it's not comfortable, given the tenor of the discussion we're having-that the debt isn't raised, per se. It exists as a matter of law as soon as a person a participant, provider or whoever receives NDIS amounts that they're not entitled to. That legal proposition is the exact same one that exists in the entirety of Australia's social security law as well. It's not a unique NDIS scheme thing. So, yes, the debt isn't so much raised; it exists. The waiver provision only operates once the debt exists. The individual does have to get notified of the debt. Senator STEELE-JOHN: just want to clarify this point. You say that the debt exists. I hate to disagree with you, but there is a proposition that the debt exists. The agency identifies that an amount has been utilised in a way that it should not have been utilised, but that is a proposition you are putting forward. Are you saying to me that there is no ability to request a review of the decision to raise the debt? Mr Swainson: There are a couple of things there. First of all, I want to talk about the process by which a debt arises. I agree with Ms Worswick it's not a decision. But can I make the point: the process by which we ascertain those facts certainly gives a participant or another person an opportunity to provide information [...] Then it goes through some human processes within the agency to determine the facts, because it arises by law. It's at that point that, if the facts are established, a debt arises and a person has an opportunity to seek a waiver, and a waiver is reviewable. 3 Objects of this Act (1) The main objects of this Act are: (a) to recognise and alleviate the impact of past institutional child sexual abuse and related abuse; and (b) to provide justice for the survivors of that abuse.

2) Specifically, has non-compliance/misuse been established, or just accusations?

The answer to 2): We still have no s46 review rights to argue our innocence.

Feedback provided in relation to the management of funding from the disability community included: The need for shared responsibility between NDIS participants and the NDIA for ensuring appropriate spending. NDIS participants need appropriate systems, guidelines and capability building approaches which support spending in accordance with their plan and on NDIS supports, reducing the risk of inadvertent or unintentional spending. The need for the NDIA to understand and consider individual circumstances in instances where a person has not spent NDIS funding appropriately to ensure appropriate responses and safeguards are put in place, acknowledging differing factors will warrant a differing or alternate response. HIGHLIGHTED: When the NDIA is considering a change to the plan management type, broader consideration needs to be given to other risks such as thin markets, or where the participant employed staff directly. All feedback has formed a key part of the input into the Rule and how it will be implemented. Feedback opportunities for capacity building around compliance with section 46 with safeguarding for participants informed the way the rule was drafted and communicated. Feedback was consistent with the rule intent to support and protect participants to use plan funding in accordance with their plan rather than be used only in response to inappropriate spending. HIGHLIGHTED: [For example, where a participant has unintentionally purchased a support not in accordance with their plan they will be provided with education and support rather than automatically change the plan management type.] However, if a participant or their plan nominee has repeatedly purchased supports not in accordance with the plan despite being advised this is not permitted, this may be considered by the NDIA as indicating the participant or plan nominee are unlikely to comply with section 46 which may indicate a change in plan management type is appropriate.

Ironic that I pulled that from an editorial in which Bill himself quoted Colleen Taylor.

In a written statement a spokesperson for the National Disability Insurance Agency, which operates the NDIS, said it was always looking at simplifying the application process. "To meet access for the NDIS a person must meet all eligibility criteria, as well as provide evidence of how their disability and reduced level functional capacity impacts their everyday life," the statement said. "The agency continues to refine the access process to make it more transparent and simpler."
