If you are going to cite. give the case cite. 473 U.S. 207. This does indeed sort what felonies are committed by different statutes, much like how GTA is not GT. but since your goal here is to claim infringement is a victimless crime, see United States v. Coviello, 225 F.3d 54, 68 (1st Cir. 2000)

feel free to argue for your distinction, but people think you are describing legal reality and you are not. case law up to the Supreme Court describes infringement as 'theft'. Harper & Row, Publrs. v. Nation Enters., 471 U.S. 539, 558, 105 S. Ct. 2218, 2229 (1985)

you should tell congress about this important distinction, considering they passed the Digital Theft Deterrence and Copyright Damages Improvement Act of 1999, the Artists’ Rights and Theft Prevention Act of 2005, and the No Electronic Theft Act.
