Craig Shirley, a presidential historian and biographer of President Ronald Reagan, said Mr. Trump's experience was so searing that he did not believe the president would improperly restrain others' free speech, whatever his public exhortations. "We all especially know Biden used government to censor Trump, kicking him off many media platforms, a clear violation of the law," Mr. Shirley said. "As his own First Amendment rights were abridged, my guess is he's especially sensitive to anyone else seeing their First Amendment rights taken away."

The AP admits as much and identifies the harms from exclusion as the loss of opportunities to "gather and quickly disseminate news about the President." Newsgathering may enjoy some First Amendment protections from government interference. See Branzburg v. Hayes, 408 U.S. 665, 707 (1972). But newsgathering is not itself a communicative activity. When journalists are invited to observe events in the Oval Office, they are gathering information for their reporting, which is "a noncommunicative step in the production of speech." Price, 45 F.4th at 1068.

The First Amendment forbids the government from penalizing private citizens and institutions because it doesn’t like what they say.
"President Shipman is trying to balance different factions, but I was disappointed," McMahon said. Naming Khalil wasn't "necessary for her to say, considering all of the campus unrest that had happened, l," McMahon said. White House officials told Columbia it should be mindful during its search for a permanent president that such comments from university leaders would again jeopardize federal funding, a senior administration official said.

Top Trump officials are closely monitoring the words and actions of university leaders. Columbia University interim President Claire Shipman in her recent commencement speech mentioned the absence of pro-Palestinian student Mahmoud Khalil, who is the custody of the U.S. Immigration and Customs Enforcement. His detention has drawn protests. The following day, the university received a notice of civil-rights violation. McMahon said the notice was in the works before Shipman's speech.

Leaders of some of the firms have seen Mr. Trump's comments in recent days and are just hoping that Mr. Trump will not follow through and press them to take on work on behalf of the administration, according to three people with direct knowledge of the matter.

nobody is bothering to say it. But if Trump is extorting millions of dollars of value in his *personal* capacity in consideration for taking or desisting from taking official government action, that seems like a textbook definition of bribery or some other form of criminal misconduct, presumably with no official immunity. Which also presumably means that the other parties to those agreements (law firms, universities, etc) have engaged in criminal conspiracy to commit bribery, with a five year statute of limitations. The likelihood of prosecution may be low, but seems like all of these

Law students: do you want to work for a firm that “bends the knee,” where you will do pro bono work to implement Trump’s agenda? No? Then apply to firms that are standing up for democracy and avoid the capitulators.

Last month, Paul Weiss removed a web page that had highlighted its “leadership in a court-ordered effort to find parents deported by the Trump administration and to reunify families.” Visitors to the page now get an error message, as do users looking for any mention of Paul Weiss’s pro bono work on behalf of L.G.B.T.Q. people.
