They're both restrictive and have been superseded by lower level vulns for exploitation though.
I remember @retr0.id posting an early switch2 UI exploit with similar constraints, you can mess with rendering but you're still bound in userland, nothing further AFAIK.

We haven't seen major UX exploits in ages, and the Switch one is so rigid mine still feels like OFW when it's already hacked and running nxthemes

Even assuming the existence of major UX exploits, you can patch those thru a software update and make it required to boot new games, blocking cfw users out
